Terms of Service

I. Terms of Service for Venues

By booking the Decathlon Facility, the User signifies his/her agreement to be bound by these terms of service.

It is hereby declared by the User or Parent/Guardian of the User that –

1. The User is using the Facility at free will and discretion, and is voluntary in nature.

2. The User or the Parent/Guardian understands that it may take some special skill and technical knowledge to use this Facility and the User or the Parent/Guardian is fully aware of the risks and dangers involved in the usage of this Facility and shall not hold Decathlon liable for any reason whatsoever.

3. The User will wear all applicable protective equipment while playing in the Facility.

4. The User and the Parent/Guardian are fully aware that the photos and videos which are captured at the Facility shall be used by Decathlon on its communications both online and offline. The User and the Parent/Guardian hereby declares that they have no objection to Decathlon’s such use of the photographs and videos and will not claim any compensation, royalty, or any similar form of payment for such use of the photos and videos. The photos/videos may be modified by Decathlon to suit the purpose and reach of the posting and display.

5. User or the Parent/Guardian acknowledges that certain personal information about the User or the Parent/Guardian (excluding sensitive personal information as defined under applicable laws) may be created and transferred by Decathlon at the time of posting and displaying the photos and videos on its social media handles and/or websites. The User or the Parent/Guardian specifically consents to the sharing of such personal information. The User and the Parent/Guardian acknowledges that certain personal information about the User and the Parent/Guardian (excluding sensitive personal information as defined under applicable laws) may be created and transferred by Decathlon at the time of posting and displaying the photos and videos on its social media handles and/or websites. The User and the Parent/Guardian specifically consents to the sharing of such personal information.

6. The User or the Parent/Guardian is fully responsible for the User’s behaviour during the Term of the booking period. The User and the Parent/Guardian will not engage, nor shall cause to engage, in any altercations, both physical and verbal, with anyone for whatsoever reason. The User and the Parent/Guardian are also responsible for the behaviour of any guests invited along with them.

7. The User or the Parent/Guardian shall ensure at all times that there is no loss or damage (including theft) caused to the properties or assets of Store, the Venue, and there shall be no loss or damage (including theft) caused to the consumables used during the facility booking period . In the Facilities there are any such losses or damages (including theft) attributable to the User , then the User or the Parent/Guardian shall be liable to reimburse Decathlon , as applicable, for the entire value of the loss or damage.

8. The User or Parent/Guardian shall ensure that all rules and instructions of the facility and all other policies, terms and conditions imposed by Decathlon are understood, respected and followed at all times. The attestation of this Discharge of Liability by the User or the Parent/Guardian shall imply the acceptance of the same. The User and the Parent/Guardian shall be responsible to enquire about all policies, terms and conditions imposed by Decathlon for the particular facility.

9. The User as well as the Parent/Guardian declares that they are not infected by any virus or disease or sickness, and are in a healthy condition to use the Facility. User, Parent/Guardian is solely responsible towards their wellbeing, including catching and spreading of any deadly viruses or diseases or sickness. The User and Parent/Guardian shall ensure that social distancing, sanitization, face masks, and other precautionary measure prescribed under the law is followed, if applicable. Decathlon shall not be responsible for the User ’s and Parent/Guardian’s health nor shall be responsible for the User / Parent/Guardian catching any virus or disease or sickness from any other person.

10. If the User or the Parent/Guardian registers other User s for any facility, User or the Parent/Guardian shall ensure that all rules and instructions of the facility and all other policies, terms and conditions imposed by Decathlon are understood, respected and followed at all times by all other User s. The User or the Parent/Guardian will indemnify Decathlon from claims, losses and liabilities arising from the breach of this clause. Additionally, the other User s shall read, understand and agree to these terms and conditions, and both the User and the Parent/Guardian shall indemnify Decathlon for any failure to comply with the same.

11. The User and the Parent/Guardian understand and agree that different facilities will have different rules, instructions, policies as well as different terms and conditions. The User and Parent/Guardian agree to understand and abide by the same.

12. The User and the Parent/Guardian hereby discharge Decathlon from all liability (present and future) which may arise in any manner whatsoever, due to the usage the facility . Decathlon shall not be liable for any accidents, hurt or death.

13. Decathlon shall have the right at any point of time to cancel the facility booking due to weather conditions, safety concerns, threats, disputes etc., and the User agrees to leave the Facility.

14. Any disputes regarding the User ’s participation in the facility shall be settled amicably between the User /Parent/Guardian with the point of contact for the particular facility , and the User and the Parent/Guardian discharge Decathlon from any responsibility regarding such disputes.

15. In the Facilities the User violates any of the policies, terms and conditions prescribed by Decathlon, which causes any harm, injury, death or damage to the life or property of another User or any person whosoever, then the User and the Parent/Guardian agree to compensate for, and face any legal charges as applicable for such harm, injury, negligence, death or damage.

16. The User or Parent/Guardian shall not be entitled to claim a refund of the transaction price (as the User or Parent/Guardian sole and exclusive remedy) in any situation, except the following–

    1. when the facility for which the User or Parent/Guardian has booked has not been opened/accessible , or cancelled by Decathlon

    2. in any other cases where Decathlon at its sole discretion offers a refund.

17. The User or Parent/Guardian understands that the refund may not be available in full or in part for certain category of facilities, services and/or transactions as mentioned in the Policies and hence the User or Parent/Guardian may not be entitled to a refund in respect of the transactions for those facilities or services.

18. Refund, if any, shall be made through the same mode of payment by which the transaction price was received.

19. Refund shall be made in Indian Rupees only and shall be equivalent to the Transaction Price received in Indian Rupees.

20. For electronics payments, refund shall be made through the Payment Services using NEFT / RTGS or any other online banking / electronic funds transfer system approved by Reserve Bank India (RBI).

21. Refund shall be conditional and shall be with recourse available to Decathlon in case of any misuse by the User or Parent/Guardian.

22. Refund shall be subjected to the User or Parent/Guardian complying with Decathlon Policies and the these TOS and any other policies as applicable.

23. As and when applicable, the User shall be required to report on time at a designated assembly points located at the Store/Venue. It shall be the sole responsibility of the User or the Parent/Guardian to ensure that the User is present at such assembly points at the mentioned times. Failure to do so will result in the cancellation of the User ’s right to play in the facility without any remedy.

24. This TOS has been executed digitally and shall be bound by the laws of India, with the courts of Bangalore having specific jurisdiction.

25. The User shall be required to read and accept TOS for such Service, which may be updated or modified by Decathlon from time to time.

26. The User hereby consents, expresses and agrees that he/she has read and fully understands the applicable Privacy Policy of Decathlon (available at Privacy Policy - Decathlon Play) and all other terms and conditions of Decathlon (available on www.decathlon.in).

27. Decathlon reserve the right, at its sole discretion, to change, modify, add, or remove portions of this Terms of Service and Privacy Policy at any time and without any prior written notice to User. It is your responsibility to review this Agreement, TOS and Privacy Policy periodically for updates/changes.

28. Users agree to be able to form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, persons of unsound mind, un-discharged insolvents etc. are not eligible to use the Platform. Decathlon reserves the right to restrict a User’s access to the Facility if it is brought to Decathlon's notice or if it is discovered that the User is incompetent to contract.

29. User consents to receive communications from Decathlon electronically. Decathlon will communicate with User via e-mail or by posting notices on the Platform periodically and as and when required. Decathlon may communicate with the User by email or by such other mode of communication, electronic or otherwise. In the event the User does not wish to receive e-mail communication from Decathlon, the User shall unsubscribe to receiving e-emails.

30. The User shall be responsible for any non-performance or breach of any contract entered into between the User and Decathlon.

31. It is possible that there could either be errors or omissions in the information provided on the Platform or such information could also be incomplete. Decathlon is not responsible for any errors, omissions or representations on any of Decathlon’s pages or any links on any of Decathlon’s pages.

32. The User releases and indemnifies Decathlon and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the User on the Platform and specifically waive any claims that the User may have on Decathlon under any applicable law. Notwithstanding its reasonable efforts, Decathlon cannot take responsibility or control the information provided by any of the Users or any information regarding Services displayed on the Platform. The User may find other Users’ information to be offensive, harmful, inconsistent, inaccurate, or deceptive. Please use caution and practice safe trading when using the Platform.

33. All commercial/contractual terms are offered by and agreed to between the User and Playo. The commercial/contractual terms include without limitation, registration fees, price, payment methods, payment terms, date, period, dates, warranties and disclaimers etc. related to the Facilities and other services.

34. The User can take a close look at the Platform for the complete description of the Facilities and services. In spite of Decathlon doing its best to describe and present the Facilities being displayed on the Platform as accurately as possible, some Facilities characteristics or description of services may be altered slightly. It is also hereby declared that Decathlon affiliated Facilities are sometimes displayed on the Platform by the Facilities organisers directly for which Decathlon has no involvement. Despite all precautions by Decathlon, there may be inadvertent errors, and Decathlon shall not under any circumstances be held liable should this arise. The pictorial depictions of the Facilities and other services displayed on the Platform are not contractually binding. Under no circumstances may Decathlon be held liable on the basis of said pictorial depictions or description of the Facilities or services being displayed. Decathlon also does not make any representation or warranty as to specifics (such as quality, value, credibility, etc.) of the Facilities or services displayed on the Platform.

35. The registration fee displayed for the Facilities and prices for the services displayed on the Platform, unless specified otherwise, are expressed in Indian Rupees and shall include all taxes applicable by law. Registration fee and prices shall not include the cost of any additional services selected by the User unless it is specifically mentioned in the description of the Facilities or services displayed on the Platform. Decathlon shall have the right to refuse or cancel any registrations or purchases done by the User. Registration Fee and prices of services as is reflected on the Platform may be subjected to some technical issues or typographical errors, or the Facilities description displayed may be incorrectly reflected including but not limited to information regarding registration fee for booking the Facilities, price of services, availability etc. and in such an event Decathlon may cancel the User’s registration or purchase.

36. The User recognises that there are risks in dealing with underage persons or people acting under false pretence and shall hold Decathlon harmless for the same.

37. Decathlon reserves the right to change its Fee Policy from time to time. In particular, Decathlon may at its sole discretion introduce new Services and modify some or all of the existing Services offered on the Platform. In such an Facilities Decathlon reserves the right to introduce a fee for the new Services offered or amend/introduce fees for existing Services, as the case may be. Changes to the Fee Policy shall be posted on the Platform and such changes shall automatically become effective immediately after they are posted on the Platform. Unless otherwise stated, all fee shall be quoted in Indian Rupees. The User shall be solely responsible for compliance of all applicable laws being in force at the time.

38. The User shall not host, display, upload, modify, publish, transmit, update or share any information which:

    1. belongs to another person and to which the User does not have any right to;

    2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or envisaging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" and other offences within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986, The Protection of Children from Sexual Offences Act (POCSO Act) 2012, The Indian Penal Code 1860;

    3. is misleading in any way or threatens to defame or harm the goodwill of Decathlon;

    4. is patently offensive to the online community, such as sexually explicit Content, or Content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;

    5. harasses or advocates harassment of another person including but not limited to the use of foul language;

    6. involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";

    7. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

    8. infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights (“IPR”), rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity];

    9. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

    10. contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);

    11. provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits Personal Information from anyone;

    12. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

    13. contains unauthorised videos, photographs, or images of another person (with a minor or an adult).

    14. tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other Users

    15. engages in commercial activities and/or sales without Decathlon’s prior written consent such as contests, sweepstakes, barter, advertising and pyramid schemes, or the buying or selling of "virtual" products related to the Platform. Throughout this Terms and Conditions, Decathlon's prior written consent means a communication coming from Decathlon's Legal Department, specifically in response to User’s request, and specifically addressing the activity or conduct for which The User seek authorization;

    16. solicits gambling or engages in any gambling activity which We, in Decathlon’s sole discretion, believes is or could be construed as being illegal;

    17. interferes with another User's use and enjoyment of the Platform or any other individual's User and enjoyment of similar services;

    18. refers to any website or URL that, in Decathlon’s sole discretion, contains material that is inappropriate for the Platform or any other website, contains Content that would be prohibited or violates the letter or spirit of these Terms and Conditions.

    19. harm minors in any way;

    20. infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent;

    21. violates any law for the time being in force;

    22. deceives or misleads the addressee/ Users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

    23. impersonate another person;

    24. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resources; or contains any trojan horses, worms, time bombs, cancel bots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or Personal Information;

    25. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prFacilities investigation of any offence or is insulting any other nation.

    26. shall be false, inaccurate or misleading;

    27. shall, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.

    28. shall create liability for Decathlon or cause Decathlon to lose (in whole or in part) the services of Decathlon’s internet service provider ("ISPs") or other suppliers;

39. The User shall not make any negative, denigrating or defamatory statement(s) or comment(s) about Decathlon or the brand name or domain name used by Decathlon including but not limited to the terms “Decathlon”, www.decathlon.in “www.play.decathlon.in”, or otherwise engage in any conduct or action that might tarnish the image or reputation of Decathlon on Platform or otherwise tarnish or dilute any of Decathlon's IPR, trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us.

40. The User shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable domestic laws, rules and regulations, and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to GST, Income Tax, Custom Duty, Local Levies) regarding the User’s use of the Facilities and purchasing services displayed therein. The User shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law or regulations for the time being in force.

41. The User shall not defame the attributes of any Facilities or services of Decathlon so as to mislead other Users in any manner.

42. The User shall not engage in advertising to, or solicitation of other Users of to register for any Facilities or purchase any services, including, but not limited to that being displayed on the Platform or related to Decathlon in any manner. The User may not transmit any chain letters or unsolicited commercial or junk email to other Users through the Platform. It shall be a violation of this TOS to use any information obtained from the Platform in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another. In order to protect the Users from such advertising or solicitation, Decathlon reserve the right to restrict the number of messages or emails which a User may send to other Users which Decathlon deems inappropriate in its sole discretion. The User understands that Decathlon has the right at all times to disclose any information (including the identity of the persons providing information or materials on the Platform) as necessary to satisfy any law, regulation, order or valid governmental request. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order or investigating authority. In addition, Decathlon can (and the User hereby expressly authorizes Decathlon to) disclose any information about the User to law enforcement or other government officials, as Decathlon believes necessary or appropriate in connection with the investigation and/or resolution of possible offences or crimes, especially those that may involve personal injury.

43. In no event shall Decathlon assume or have any responsibility or liability for any Content posted by a User for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Platform.

44. Decathlon shall have all the rights to take necessary action and claim damages that may occur due to User’s involvement/participation in any way by the User’s own participation or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services).

45. The User shall not have the right to resell any access granted to the Platform, the Facilities the User registers in, or the services purchased on the Platform unless such right is expressly granted to the User in writing by Decathlon.

46. Privacy Policy –

    1. Decathlon understands clearly that the User and the User’s Personal Information (name, age, phone number, pin code, billing address, delivery address, User name, password, sports interests etc, and other information as may be amended from time to time, collectively known as “Personal Information”). Decathlon stores and processes the User’s Information and Content including any sensitive financial information collected (as defined under the Information Technology Act, 2000), if any, as per applicable laws.

    2. Decathlon may share Personal Information and Content with Decathlon’s other corporate entities and affiliates. These entities and affiliates may market to the User as a result of such sharing unless the User explicitly opts out to such marketing.

    3. Decathlon may disclose Personal Information (other than “sensitive” Personal Information if collected) and Content to third parties. This disclosure may be required for Decathlon to provide the User access to the Facilities, to comply with Decathlon’s legal obligations, to enforce the contracts between Decathlon and the User, to facilitate Decathlon’s marketing and advertising activities, or to prevent , detect, mitigate, and investigate fraudulent or illegal activities. Decathlon does not disclose the User’s Personal Information and Content to third parties for their marketing and advertising purposes without the User’s explicit consent.

    4. Decathlon may disclose Personal Information and Content if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal processes. Decathlon may disclose Personal Information and Content to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to (i) enforce this Agreement or Privacy Policy, (ii) respond to claims that an advertisement, posting or other Content violates the rights of a third party, or (iii) to protect the rights, property or personal safety of Decathlon’s Users, customers or the general public.

    5. Decathlon and Decathlon’s affiliates will share / sell some or all of the User’s Personal Information and Content with other business entities should Decathlon (or Decathlon’s other entities or assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamate, or restrict the business. Should such a transaction occur, the other business entity (or the new combined entity) will be required to follow this Agreement and the Privacy Policy with respect to User’s Personal Information.

    6. Users must also ensure that the Users protect their information and any other information gathered from the Platform confidentially, and shall be bound by this Privacy Policy. Any suspected or proven leak of information from the end of the User due to any violation of this Policy or due to the violation of the applicable laws shall lead to closure or suspension of the User’s access and the User shall be liable to indemnify Decathlon for the same.

    7. Decathlon will not be liable to the User in any way or in relation to the Contents of, or use of, or otherwise in connection with, the Platform.

    8. Nothing on the Platform constitutes, or is meant to constitute, advice of any kind. All the Facilities and services displayed and made available for transactions on the Platform are governed by different state laws and if for whatsoever reason the conduct or delivery of such Facilities or services due to implications of different state laws is not possible.

47. Payment Services - The payment which are made available on the Platform may be made available through payment gateway or appropriate payment system infrastructure services of third party service providers or through any other methods of payments. While availing any of the payment method/s available on the Platform, Decathlon will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to the User in this regard.

48. The User shall electronically notify Decathlon of any cancellation of the booked transactions/Facilities, forty eight (48) hours prior to the date of the booking. Non notification by the User regarding the same shall be construed as if the obligations set forth on Decathlon regarding the transactions or regarding the conduct of any Facilities or services have been deemed to have been concluded by Decathlon.

49. Decathlon also reserves the right to restrict the number of registrations done by the User for the Facilities, and also for the quantity of services sought to be purchased by the User on the Platform.

50. Decathlon reserves the right to refuse bookings made by Users including without limitation when Users have a prior history of questionable charges or any breach of any agreements by the User with Decathlon or breach/violation of any law or any charges imposed by Issuing Bank or breach of any law or policy.

51. The User acknowledges that Decathlon will not be liable for any damages, interests or claims etc. resulting from not processing a transaction/transaction price or any delay in processing a transaction/transaction price which is beyond control of Decathlon.

52. Compliance with Laws:

    1. User shall comply with all the applicable laws (including without limitation Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Customs Act, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention ion of Money Laundering Act, 2002 and the rules made thereunder, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, Export Import Policy of government of India) applicable to them respectively for using the Payment Services and the Platform.

53. Profanity Policy - Decathlon prohibits the use of language that is foul, racist, hateful, sexual or obscene in any areas including the Platform.

54. Indemnity - The User shall indemnify and hold harmless Decathlon, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of the User’s breach of these TOS, Privacy Policy and other Policies of Decathlon, or the User’s violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

55. Applicable Law & Dispute Resolution - Terms and Conditions shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively with courts of Bangalore.

56. Jurisdictional Issues/Sale in India Only - Unless otherwise specified, the Facilities and services displayed on the Platform are presented solely for the purpose of transactions in India. Decathlon makes no representation that the said Facilities and services displayed on the Platform are appropriate or available for use in other locations/countries other than India. Users who choose to access this site from other locations/countries other than India do so on their own initiative and Decathlon is not responsible for the conduct of the Facilities or delivery services, refunds, for transactions done from other locations/Countries other than India, compliance with local laws, if and to the extent local laws are applicable. If a User lives outside India, please refer to the partners within the Decathlon GROUP.

57. Intellectual Property - Decathlon is the owner of all the rights of intellectual property attached to the Facilities, products/services of Decathlon ordered by the User. Decathlon reserves the right to proceed to the necessary formalities with the aim of their protection on their intellectual property. Decathlon undertakes to the User a non-exclusive right of use on the brands and protected elements owned by Decathlon. The User recognises the existence and validity of the trademark applications or registrations and use of Decathlon's products and undertakes never to challenge their validity, registration and use in the Territory. The User undertakes not to derive any right from the registration and participation in the Facilities and use of Decathlon's services and undertakes never to attempt to register, directly in his name or indirectly by a third party, any identical or confusingly similar trademark or internet domain name that may infringe Decathlon's trademarks or constitute unfair competition. In case the User applies for or uses any identical or similar trademark or domain name to Facilities or services displayed on the Platform, they shall immediately take all necessary actions, at their own expense, to cancel or transfer the infringing trademarks or domain names to Decathlon upon Decathlon's first demand. The User undertakes to inform and to immediately notify Decathlon of illicit imitation and more generally of any unfair competition practices based on the Protected Elements through the IP violation intimation email ID given below.

58. Trademark, Copyright and Restriction - All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. The User must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and the User must not assist any other person to do so.

59. Decathlon does not warrant that the Facilities and services description or other content of this Platform are completely accurate, complete, current, or error-free and assumes no liability in this regard.

60. Limitation of Liability - In no event shall Decathlon be liable for any special, incidental, indirect or consequential damages of any kind in connection with this TOS, even if the User has been informed in advance of the possibility of such damages.

63. Email Abuse & Threat Policy

    Private communication, including email correspondence, is not regulated by Decathlon. Decathlon encourages its Users to be professional, courteous and respectful when communicating by email. However, Decathlon will investigate and can take action on certain types of unwanted emails that violate Decathlon policies.

    Such instances shall include without limitation:

    1. Threats of Bodily Harm - Decathlon does not permit Users to send explicit threats of bodily harm.

    2. Misuse of Decathlon System - Decathlon allows Users to facilitate transactions through the Decathlon system, but will investigate any misuse of this service.

    3. Spoof (Fake) email - Decathlon will never ask the User to provide sensitive information through email. In case the User receive any spoof (fake) email, the User are requested to report the same to Decathlon through the ‘Contact Us' details.

    4. Spam (Unsolicited Commercial email) - Decathlon's spam policy applies only to unsolicited commercial messages sent by Decathlon Users. Decathlon Users are not allowed to send spam messages to other Users.

    5. Offers to Buy or Sell Outside of Decathlon - Decathlon prohibits email offers to buy or sell listed Facilities or products/services which are not authorized by Decathlon. Offers of this nature are a potential fraud risk for both the Users and Decathlon.

    Decathlon policies prohibits User-to-User threats of physical harm via any method including, phone, email and on Decathlon’s public message boards.

64. Violations of this TOS may result in a range of actions, including:

    1. Limits on account privileges

    2. Account suspension

    3. Cancellation of listings

    4. Loss of special status

    5. Legal action before the appropriate authority

II. Terms of Services for Events & Coaching

It is hereby declared by the Participant or Parent/Guardian of the Participant that -

1. The Participant is participating in the Event at free will and discretion, and is completely voluntary in nature.

2. The Participant or the Parent/Guardian understands that it may take some special skill and technical knowledge to participate in this Event and the Participant or the Parent/Guardian is fully aware of the risks and dangers involved in the participation in this Event.

3. The Participant will wear all applicable protective equipment while participating in the Event.

4. The Participant and the Parent/Guardian are fully aware that the photos and videos which are captured during the Event shall be used by Decathlon on its communications both online and offline. The Participant and the Parent/Guardian hereby declares that they have no objection to Decathlon’s such use of the photographs and videos and will not claim any compensation, royalty, or any similar form of payment for such use of the photos and videos. The photos/videos may be modified by Decathlon to suit the purpose and reach of the posting and display.

5. Participant or the Parent/Guardian acknowledges that certain personal information about the Participant or the Parent/Guardian (excluding sensitive personal information as defined under applicable laws) may be created and transferred by Decathlon at the time of posting and displaying the photos and videos on its social media handles and/or websites. Further, the Participant or the Parent/Guardian agrees that Decathlon may transfer certain personal information of the Participant or the Parent/Guardian to the Organiser of the Events. The Participant or the Parent/Guardian specifically consents to the sharing of such personal information.

6. The Participant and the Parent/Guardian acknowledges that certain personal information about the Participant and the Parent/Guardian (excluding sensitive personal information as defined under applicable laws) may be created and transferred by Decathlon at the time of posting and displaying the photos and videos on its social media handles and/or websites. The Participant and the Parent/Guardian specifically consents to the sharing of such personal information.

7. The Participant or the Parent/Guardian is fully responsible for the Participant’s behaviour during the Term of the Event. The Participant and the Parent/Guardian will not engage, nor shall cause to engage, in any altercations, both physical and verbal, with anyone for whatsoever reason. The Participant and the Parent/Guardian are also responsible for the behaviour of any guests invited along with them.

8. The Participant or the Parent/Guardian recognises that there may be an Organiser conducting the Event and the Participant’s or the Parent/Guardian’s relationship with such Organiser shall be bilateral and Decathlon shall not be responsible for any liability arising from the default of the Organiser.

9. The Participant or the Parent/Guardian shall ensure at all times that there is no loss or damage (including theft) caused to the properties or assets of Store, the Venue, and there shall be no loss or damage (including theft) caused to the consumables used during the Event. In the event there are any such losses or damages (including theft) attributable to the Participant, then the Participant or the Parent/Guardian shall be liable to reimburse Decathlon or the Organiser, as applicable, for the entire value of the loss or damage.

10. The Participant or Parent/Guardian shall ensure that all rules and instructions of the Event and all other policies, terms and conditions imposed by Decathlon are understood, respected and followed at all times. The attestation of this Discharge of Liability by the Participant or the Parent/Guardian shall imply the acceptance of the same. The Participant and the Parent/Guardian shall be responsible to enquire about all policies, terms and conditions imposed by Decathlon as well as an Organiser for the particular Event.

11. The Participant as well as the Parent/Guardian declares that they are not infected by any virus or disease or sickness, and are in a healthy condition to participate in the Event. Participant, Parent/Guardian is solely responsible towards their wellbeing, including catching and spreading of any deadly viruses or diseases or sickness. The Participant and Parent/Guardian shall ensure that social distancing, sanitization, face masks, and other precautionary measure prescribed under the law is followed. Decathlon shall not be responsible for the Participant’s and Parent/Guardian’s health nor shall be responsible for the Participant/ Parent/Guardian catching any virus or disease or sickness from any other person.

12. If the Participant or the Parent/Guardian registers other participants for any Event, Participant or the Parent/Guardian shall ensure that all rules and instructions of the Event and all other policies, terms and conditions imposed by Decathlon are understood, respected and followed at all times by all other participants. The Participant or the Parent/Guardian will indemnify Decathlon from claims, losses and liabilities arising from the breach of this clause. Additionally, the other participants shall read, understand and agree to these terms and conditions, or as applicable, shall be signed by the Parent/Guardian, and both the Participant and the Parent/Guardian shall indemnify Decathlon for the failure of the same.

13. The Participant and the Parent/Guardian understand and agree that different Events will have different rules, instructions, policies as well as different terms and conditions. The Participant and Parent/Guardian agree to understand and abide by the same.

14. The Participant and the Parent/Guardian hereby discharge Decathlon from all liability (present and future) which may arise in any manner whatsoever, due to the participation in the Event. Decathlon shall not be liable for any accidents, hurt or death.

15. Decathlon or the Organiser shall have the right at any point of time to stop the Event due to weather conditions, safety concerns, threats, disputes etc., and the Participant agrees to leave the Venue or any dedicated area of the Venue where such Event is being conducted.

16. Any disputes regarding the Participant’s participation in the Event shall be settled amicably between the Participant/Parent/Guardian with the point of contact/Organiser for the particular event, and the Participant and the Parent/Guardian discharge Decathlon from any responsibility regarding such disputes.

17. In the event the Participant violates any of the policies, terms and conditions prescribed by Decathlon and the Organiser for the Event, which causes any harm, injury, death or damage to the life or property of another Participant or any person whosoever, then the Participant and the Parent/Guardian agree to compensate for, and face any legal charges as applicable for such harm, injury, negligence, death or damage.

18. The Participant or Parent/Guardian shall not be entitled to claim a refund of the transaction price (as the Participant or Parent/Guardian sole and exclusive remedy) in any situation, except the following–

    1. when the Event for which the Participant or Parent/Guardian has registered has not been conducted, or cancelled by Decathlon or the Organiser of the Event

    2. in any other cases where Decathlon at its sole discretion offers a refund.

19. The Participant or Parent/Guardian understands that the refund may not be available in full or in part for certain category of Events, services and/or transactions as mentioned in the Policies and hence the Participant or Parent/Guardian may not be entitled to a refund in respect of the transactions for those Events or services.

20. Refund, if any, shall be made through the same mode of payment by which the transaction price was received.

21. Refund shall be made in Indian Rupees only and shall be equivalent to the Transaction Price received in Indian Rupees.

22. For electronics payments, refund shall be made through the Payment Services using NEFT / RTGS or any other online banking / electronic funds transfer system approved by Reserve Bank India (RBI).

23. Refund shall be conditional and shall be with recourse available to Decathlon in case of any misuse by the Participant or Parent/Guardian.

24. Refund shall be subjected to the Participant or Parent/Guardian complying with Decathlon Policies and the User T&C/Agreement.

25. As and when applicable, the Participant shall be required to report on time at a designated assembly points located at the Store/Venue. It shall be the sole responsibility of the Participant or the Parent/Guardian to ensure that the Participant is present at such assembly points at the mentioned times. Failure to do so will result in the cancellation of the Participant’s right to participate in an event without any remedy.

26. This Terms & Conditions and Discharge of Liability has been executed digitally and shall be bound by the laws of India, with the courts of Bangalore having specific jurisdiction.
